This is a letter I have received from Blundstone Pty Ltd.
All customers should be aware of its contents...
Dear Paul,
We hereby put you on notice that Blundstone safety footwear does not have Safety accreditation in many international countries. For this reason Blundstone Pty Ltd does not sell, via its distributors, safety product in most of the countries to which we export – this includes for example the US & the UK. Blundstone Pty Ltd accepts no responsibility for any claims made against you where you have sold product as "safety product" into any country (whether or not we hold safety accreditation for the country from which the claim is made).
...We further advise you to place on your website disclaimers as to the use of the footwear. As part of that we ask that you place the following disclaimer on your site:
"Blundstone Pty Ltd does not warrant any footwear sold by blundstoneboots.com outside of Australia as safety footwear and does not warrant that any footwear is compliant with any relevant safety accreditations or otherwise".
We also request that in every instance where a customer orders a product that they may construe to be a safety product that you provide clear and unambiguous advice to them that the product is not sold as a safety product and is not to be used for that purpose and the Blundstone Pty Ltd does not provide any warranties in respect to the use of that product for safety purposes.
We also ask that you place a disclaimer on your website stating that:
"blundstoneboots.com is not an authorised international distributor of Blundstone products".
We also note that you refer to the use of “waterproof leathers”. Please be advised that Blundstone Pty Ltd does not make any claim regarding the use of “waterproof leathers” and for you to make such assertions could well be construed as false and misleading. We advise you to remove all such references.
Regards,
Andrew Ross
Group Chief Financial Officer
